1. Introduction

These Terms & Conditions (“Terms”) govern your access to and use of the services, products, and platforms provided by Random Solutions Pty Ltd (“Random Solutions”, “we”, “our”, “us”), including but not limited to the ResiKEY platform.

By accessing or using our services, you agree to be bound by these Terms. Please read them carefully before using any product or service offered by Random Solutions Pty Ltd.


2. Company and Product Relationship

ResiKEY is a product of Random Solutions Pty Ltd, which is responsible for its operation, management, and ongoing development.

All references in these Terms to “we”, “our”, or “us” include both Random Solutions Pty Ltd and its associated products, including ResiKEY.


3. Eligibility

You must be at least 18 years of age to use our services.
 By creating an account or accessing our platforms, you confirm that you meet this eligibility requirement and have the authority to enter into a binding agreement.


4. Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials, including your username, password, and any authentication methods used to access the platform.

You agree to:

  • Immediately notify us of any unauthorised use of your account or security breach.
  • Take reasonable steps to protect your login information and devices.
  • Accept responsibility for all activities that occur under your account credentials.
  • We are not liable for any loss or damage resulting from your failure to safeguard your account credentials.


5. Collection and Use of Mobile Phone Numbers

As part of our commitment to secure access, we collect and store your mobile phone number for multi-factor authentication (MFA) purposes when accessing both our mobile and web applications.

MFA codes are delivered via SMS and are mandatory for account protection.

These messages cannot be opted out of, as they are essential to system security.

Your mobile phone number will not be used for marketing or unrelated communications.

When your account is deleted, all associated contact numbers and authentication data are permanently deleted from our systems.


6. Acceptable Use

You agree not to misuse or interfere with the operation of our platforms. This includes, but is not limited to:

Attempting to gain unauthorised access to any system or account.

Introducing malicious code, malware, or performing denial-of-service attacks.

Using the service for any unlawful, harmful, or fraudulent purpose.

Attempting to reverse-engineer, modify, or copy any part of the platform.

We reserve the right to suspend or terminate your access if we determine that your actions violate these Terms or compromise platform integrity.


7. Intellectual Property

All intellectual property rights, including software, trademarks, logos, branding, content, and documentation, remain the exclusive property of Random Solutions Pty Ltd and its licensors. You may not copy, modify, distribute, reproduce, or create derivative works from any part of our platform or materials without our prior written consent. Use of our trademarks or trade names without authorisation is strictly prohibited.


8. Privacy & Data Protection

We are committed to protecting your personal information and complying with all relevant data protection laws, including the Privacy Act 1988 (Cth) and applicable principles from the General Data Protection Regulation (GDPR).

In summary:

  • We only collect personal data necessary to provide and secure our services.
  • We do not use your data, including your mobile phone number, for marketing without your explicit consent.
  • You have the right to request access to or deletion of your personal data, subject to legal and security obligations.
  • When your account is deleted, all associated personal data (including mobile phone numbers) is permanently removed.

9. Limitation of Liability

To the maximum extent permitted by law, Random Solutions Pty Ltd and its affiliates, directors, employees, and partners shall not be liable for any:

Indirect, incidental, consequential, or punitive damages;

Loss of data, profits, goodwill, or business opportunities;

Damages resulting from your use of or inability to use the service.

Our total liability in connection with the service shall not exceed the amount paid (if any) by you for access to the platform in the twelve (12) months preceding the claim.


10. Termination

We reserve the right to suspend or terminate your account or access to our services at our discretion if you breach these Terms or engage in conduct deemed harmful to our business or users.

Upon termination or account deletion:

Your access to the platform will cease immediately.

All associated personal data, including contact numbers and authentication data, will be permanently deleted in accordance with our Privacy Policy.


11. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia, and you agree to submit to the exclusive jurisdiction of the courts of Victoria, Australia.
